This Dispute Resolution provision is incorporated into and forms part of the Terms of Use governing DateAndTimePro.com (the "Platform"), operated by Relationale LLC. Please read it carefully.
Governing law
These Terms and any dispute arising out of or relating to them or the Platform are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles, except to the extent that mandatory consumer-protection laws of your jurisdiction apply.
Informal resolution first
Before filing a formal claim, you agree to first contact support@dateandtimepro.com and provide a brief written description of the dispute and the relief sought. The parties will attempt in good faith to resolve the dispute informally for at least sixty (60) days before initiating formal proceedings.
Binding individual arbitration
To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be resolved by binding individual arbitration administered by a reputable arbitration provider (such as the American Arbitration Association) under its applicable consumer rules. The arbitration shall take place in Delaware, United States, or another mutually agreed location, and may be conducted remotely.
Class action waiver
YOU AND RELATIONALE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Exceptions
- Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction.
- Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information.
Severability
If any portion of this Dispute Resolution provision is held unenforceable, the remainder shall continue in effect to the fullest extent permitted by applicable law.
